Faits Motorola, société de droit américain ayant son siège aux USA, entretient des relations contractuelles avec Telsim, société turque appartenant au « Groupe Rumeli » (qui est aux mains des membres de la famille Uzan, en particulier Murat Hakan Uzan). En lien avec un procès civil intenté à New York, le 30 mai 2002, Motorola obtient de la High Court of Justice de Londres une Freezing Injunction contre Murat Hakan Uzan. Cette mesure a pour effet de bloquer les valeurs patrimoniales de Uzan jusqu’à concurrence d’un montant de US$ 200 millions. Annexe B. ch. 7 à cette Freezing Injunction: « The Applicant will not without the permission of the court seek to enforce this order in any country outside England and Wales or seek an order of a similar nature including orders conferring a charge or other security against the Respondent or the Respondent’s assets. » Le 12 novembre 2002 cette annexe est modifiée ainsi: « The Applicant will not, without the permission of the court, seek to enforce this Order in any country outside England and Wales; or (ii) seek an Order of a similar nature (including Orders confirming a charge or other security against the Respondant or the Respondant’s assets) from any Court outside England and Wales other than […] (d) the District Court of Zurich, Switzerland, […]. » Le 12 novembre 2002, Motorola demande au Einzelrichter des Bezirks Zürich de reconnaître et de déclarer exécutoire la Freezing Injunction du 30 mai 2002. Le tribunal rejette la demande. Le 31 mars 2003, l’Obergericht des Kantons Zürich reconnaît la Freezing Injunction du 30 mai 2002 et la déclare exécutoire. Uzan saisit le Tribunal fédéral d’un recours de droit public.

En droit La Freezing Injunction est une mesure qui n’est pas connue en droit suisse. Une Freezing Injunction (ou « Freezing Order » ou « Mareva Injunction » ou « Mareva Order »)
